技術(shù)保障

法律保障
2022年3月1日，最新修改的《中華人民共和國(guó)種子法》（簡(jiǎn)稱《種子法》）正式施行，是《種子法》自2000年頒布以來(lái)經(jīng)過(guò)的第四次修改，擴(kuò)大了植物新品種權(quán)的保護(hù)范圍及保護(hù)環(huán)節(jié)，將保護(hù)范圍由授權(quán)品種的繁殖材料延伸到收獲材料，將保護(hù)環(huán)節(jié)由生產(chǎn)、繁殖、銷售擴(kuò)展到生產(chǎn)、繁殖和為繁殖而進(jìn)行處理、許諾銷售、銷售、進(jìn)口、出口、儲(chǔ)存等。本次修訂最大的調(diào)整在于建立實(shí)質(zhì)性派生品種制度，進(jìn)一步規(guī)范育種行為，有效遏制惡意模仿育種、簡(jiǎn)單修飾性育種的行為，原始創(chuàng)新權(quán)利人的利益得到保障，對(duì)維護(hù)良好的種業(yè)創(chuàng)新環(huán)境、引導(dǎo)企業(yè)加大育種研發(fā)投入、吸引更多的國(guó)外優(yōu)良品種具有重要意義。

Development concepts
Wald Company takes the protection and development of intellectual property rights of new plant varieties as the foundation of the company's development. By integrating the transfer and authorization of intellectual property rights of new domestic and foreign horticultural plant varieties, it introduces and exports new plant varieties, to establish a legal and orderly exchange mechanism for international new plant variety intellectual property rights and a scientific and paid development and utilization system.
Professional advantages
Members of Wald Company have long been engaged in research work on the collection, preservation, excavation and utilization of forest germplasm resources. They have nearly 40 years of experience in education and research on China’s plant germplasm resources, and have a deep understanding of ornamental plant germplasm resources. Master the morphology, habits, distribution and other characteristics of most Chinese plants. A large number of germplasm resources have been collected and cultivated, and we have cooperated with more than 20 domestic universities, botanical gardens and research institutes in China to carry out related breeding work.
Technicals Support
Our company members are familiar with the UPOV protection system and related documents, the "DUS Testing Guide for New Plant Varieties", and master the national "Regulations on the Protection of New Varieties of Forestry Plants" and related laws and policies; our company will use DNA barcoding technology to apply for and protect new varieties: According to biological The differential characteristics of sample genes, through multiple labeling technology, sequencing technology and unique sample separation technology, establish unique DNA characteristic bands belonging to the species, effectively identify different biological samples, and form an independent and reliable unique identification at the genetic level. This identifier is stored with the plant gene library to quickly identify species. The new varieties applied for by our Wald company will all use this technology.
Legals protection
On March 1, 2022, the latest revision of the "Seed Law of the People's Republic of China" (hereafter referred to as the "Seed Law") was officially implemented. It is the fourth revision of the "Seed Law" since its promulgation in 2000, expanding the rights to new plant varieties. The protection scope and protection links shall be extended from the propagation materials of authorized varieties to harvest materials, and the protection links shall be extended from production, breeding and sales to production, breeding and processing for breeding, offering for sale, sale, import and export, storage, etc. The biggest adjustment in this revision is to establish a substantive derived variety system to further standardize breeding behaviors and effectively curb malicious imitation breeding and simple modified breeding. The interests of original innovation rights holders are protected, and it is important to maintain a good seed industry innovation environment and it is of great significance to guide enterprises to increase investment in breeding research and development and attract more foreign excellent varieties.
